Terms of Service

1. Introduction

Welcome to Pluviax. These Terms of Service ("Terms") govern your use of the Pluviax platform, website, and services (collectively, the "Service") operated by Pluviax ("we," "us," or "our").

By accessing or using Pluviax, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 18 years old to use Pluviax. By using the Service, you represent and warrant that you meet this requirement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Accounts

To access certain features, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Providing accurate and complete information
• Notifying us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms.

4. The Pluviax Marketplace

Pluviax is a marketplace connecting clients ("Buyers") with independent artists ("Creators") for the purpose of commissioning custom creative work. Pluviax acts as an intermediary platform and is not a party to any agreement between Buyers and Creators.

Creators are independent contractors, not employees, agents, or partners of Pluviax.

5. Commissions and Payments

When a Buyer commissions work through Pluviax:

• During beta, payments are completed directly between Buyers and Creators using external methods (PayPal, Wise, GCash, etc.). Pluviax provides structure, communication, and order tracking
• A platform service fee may be deducted in future. During beta, no platform fee is charged
• Fees and pricing are set by individual Creators and displayed on their profiles
• Pluviax does not process or hold payments during beta. Buyers and Creators are responsible for completing payment directly
• During beta, commissions are capped at $20 USD per order

Pluviax is not responsible for disputes arising from the quality, delivery, or content of commissioned work, though we provide tools to facilitate resolution.

6. Refunds and Disputes

Refund eligibility depends on the status of the commission:

• Before work begins: Full refund available if the artist has not yet started work
• After work begins: Partial refunds may be available at the Creator's discretion
• After delivery: Refunds are generally not available once the Buyer has approved the final work

7. Creator Responsibilities

Creators using Pluviax agree to:

• Deliver work that reasonably matches the agreed commission brief
• Communicate professionally and promptly with Buyers
• Not accept commissions they cannot complete in the agreed timeframe
• Represent their skills and capabilities accurately
• Comply with all applicable laws, including tax obligations in their jurisdiction

8. Intellectual Property

Unless explicitly agreed otherwise in writing between the Buyer and Creator:

• Creators retain ownership of their original artwork and creative work
• Upon full payment, Buyers receive a license to use the commissioned work for personal purposes
• Commercial rights, exclusivity, or copyright transfer must be explicitly negotiated and agreed upon between the parties

Pluviax does not claim ownership of any content created or uploaded by users.

9. Prohibited Content and Conduct

You agree not to use Pluviax to:

• Upload, commission, or distribute illegal, harmful, or offensive content
• Infringe the intellectual property rights of others
• Engage in fraud, misrepresentation, or deceptive practices
• Harass, threaten, or abuse other users
• Circumvent or attempt to circumvent our payment system
• Use the platform for any purpose that violates applicable law

We reserve the right to remove content and suspend accounts that violate these rules.

10. Platform Availability

We strive to maintain continuous availability of the Service but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications at any time. We are not liable for any losses resulting from Service downtime or interruptions.

11. Limitation of Liability

To the maximum extent permitted by law, Pluviax shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or goodwill.

Our total liability for any claim arising from your use of the Service shall not exceed the total fees paid by you to Pluviax in the twelve months preceding the claim.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, secure, or meet your specific requirements.

13. Governing Law

These Terms are governed by the laws of the United Arab Emirates. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of the UAE.

14. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes by updating the "Last updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the updated Terms.
